This Privacy Policy describes how Hodgson collects, uses, discloses, and safeguards personal information when you visit our websites, use our services, or otherwise interact with us online or offline (collectively, the “Services”). We also describe the measures we take to protect the security of the information and how individuals can contact us about our privacy practices.

II. The Information We Collect

We collect information about you if you communicate with us through emails or calls. The types of personal information collected include:

  • Company Name.
  • Company Email Address.
  • Phone Number.
  • Contact Information: Address and other provided contact details.
  • Job title
  • Online presence, e.g., websites, LinkedIn profile, etc. 
  • Customer Service Information: Survey responses and other information you provide to customer service.

We may collect additional information about you from third-party sources where we have the rights to do so. When we collect personal information from third parties, the data consists of publicly available personal information compiled from business websites, public-facing social media platforms, and other widely used public sources. We may collect this data to determine your business industry, make recommendations about your IT systems and keep you apprised of our service offerings, 

We do not collect special categories of personal data (such as data revealing racial or ethnic origin, political opinions, religious beliefs, health data, or biometric data). 

Our website uses cookies, tracking pixels, and related technologies for various purposes, including to operate and personalize the website and to track how you use the site to target ads to you on other websites. III. How We Use Your Information

A. Primary Processing Purposes

We use the information you provide about yourself when placing an order to complete that request for information and to advise you of updates to our service offerings. 

We do not use automated decision making to make decisions that have legal impact on you or that significantly affect your rights and liberties. All automated processing activities are conducted with appropriate human supervision and review. 

B. Marketing and Communications

We may use information you provide us to provide you marketing information or our newsletter, eBooks, whitepapers, or requested services, as well as get updates on our new products and services. Each email communication has an opt-out election and you may at any time elect not to receive these marketing communications.

C. Website Improvement and Analytics 

We use non-identifying and aggregate information to better design our website, but we would not disclose anything that could be used to identify those individuals.

F. Jurisdiction and Choice of Law. 

This site is controlled and operated by Hodgson Consulting from its offices with the United States.  Hodgson Consulting makes no representation that the materials are appropriate or available for use in other location. Any dispute involving this Privacy Policy shall be governed by, construed and enforced in accordance with the laws of the State of Illinois and shall be brought only in the state of federal courts in the United States District Court for the Northern District of Illinois and you expressly consent to the jurisdiction of such courts.

V. Information Sharing and Disclosure

A. General Sharing Practices

We do not share personal information with outside parties except to the extent necessary to complete the requested process. We never use or share the personally identifiable information provided to us online in ways unrelated to the ones described in this policy without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses. To protect personal data that is transferred internationally, we comply with all applicable data transfer laws, including incorporating required data transfer terms into our agreements with our affiliates, service providers, and third parties.

    You have the right to object to processing of your personal data based on legitimate interests, direct marketing, or processing for scientific/historical research or statistical purposes.
  7. Right Not to be Subject to Automated Decision-Making You have the right not to be subject to decisions based solely on automated processing, including profiling, which produces legal effects or similarly significantly affects you.

B. California Consumer Privacy Act (CCPA/CPRA) Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

    • Correct: Request correction of inaccurate personal information.
    • Limit: Request to limit the use and disclosure of sensitive personal information.

    We do not sell or share personal information to third parties for monetary consideration. However, we may share personal information for business purposes as described in this policy. California residents can opt out of any future sales by contacting us using the information in the Contact section.

    We do not collect or process sensitive personal information without appropriate safeguards and legal bases.

Upon receipt of your request to exercise your data-protection rights, we will acknowledge receipt within the time period required by applicable law and provide you with information about the next steps in the process and timing. 

We may deny or limit requests in certain circumstances, including:

  • When we cannot verify your identity.
  • When the request is manifestly unfounded or excessive.
  • When disclosure would adversely affect others’ rights and freedoms.
  • When retention is required by law.

D. Marketing Opt-Out

We will use your personal data to send you updates (by email, text message, or telephone) about our products and services, including exclusive offers, promotions, or new products and services. We process personal data for marketing and communications purposes and providing that information to use is a demonstration of your consent. to receive marketing communications (see above “How We Use Your Information”). D. Do not Track Signals

We currently do not respond to DNT signals but will continue to monitor developments in this area.

We protect and safeguard your personal data in the United States, in accordance with applicable law, our privacy and data security policies, and this Privacy . Those who choose to access this site from other locates do so on their own initiative and are responsible for compliance with applicable local laws. We use generally accepted standards of technical and operational security to protect your personal data against accidental or unlawful loss, misuse, alteration, or destruction, in consideration of the risks associated with the personal data and its processing.

Only authorized personnel of Hodgson and of our service providers are permitted to access personal data, and these employees and service providers are required to treat this information as confidential. We require the same level of protection and safeguarding from our subsidiaries and affiliates, our service providers, and third parties. Despite these precautions however, we cannot guarantee that unauthorized persons will not obtain access to your personal data.

We maintain incident response procedures to address potential data breaches or security incidents. In the event of a personal data breach, we will notify the relevant supervisory authority and affected individuals without undue delay when required by law.

IX. Data Retention and Deletion

We will retain your personal information for as long as is reasonably necessary for the purposes for which it was collected, in alignment with our business needs (for example, to provide you with our services). In some circumstances we may store your personal information for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax, and accounting requirements. Additionally, we may store your personal information for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your personal information or dealings.

If you request that we delete your personal data, Hodgson will comply with applicable law and will make reasonable attempts to delete all instances of the personal data, subject to our right to keep a copy of such data for the purposes mentioned above. X. Children’s Privacy

Hodgson does not intentionally use its site or business content to collect or maintain personal data from individuals under the age of 16. To the extent that any of our non-site business activities may involve collecting or maintaining personal data from or about individuals under the age of 16, we would do so only with the required legal consent from the parent, guardian, or individual and in accordance with applicable law.
